3. ORDERS AND CONTRACT FORMATION
3.1 Placing an Order constitutes an offer to purchase the Goods described in the Order.
3.2 An automated receipt or payment acknowledgement does not necessarily constitute acceptance of an Order.
3.3 An Order becomes binding when Grill King expressly confirms acceptance.
3.4 Before acceptance, Grill King may decline an Order for legitimate reasons, including:
(a) stock unavailability;
(b) material pricing or listing errors;
(c) payment authorisation failure;
(d) reasonable suspicion of fraud;
(e) inability to supply the requested configuration;
(f) delivery restrictions; or

4.4 Deposits
Unless otherwise agreed in writing:

(c) Goods will not ordinarily be released until all amounts due have cleared.

(b) Pre-Order Goods;
(c) Incoming Stock;
(d) Special Order Goods;
(e) Custom-Made Goods; or
(f) Clearance or Floor-Stock Goods.
5.3 Order classification will be based on the actual supply arrangement, not merely the existence of an Order.
5.4 Special Order Goods may include standard catalogue products not held in available local inventory and specifically purchased from a supplier to fulfil a Customer's Order.
5.5 Custom-Made Goods include Goods manufactured or modified to agreed customer-specific requirements.
5.6 The relevant classification and any material cancellation implications should be disclosed before purchase and confirmed in the Order documentation.
5.7 If Goods become unavailable after acceptance, Grill King will notify the Customer and discuss an appropriate alternative, revised timeframe or applicable remedy.
6. SPECIAL ORDER AND CUSTOM-MADE GOODS
6.1 Customers acknowledge that Grill King may incur procurement and manufacturing commitments when fulfilling Special Order and Custom-Made Goods.
6.2 Such commitments may include:

(d) component and material procurement;
(e) international freight bookings;

(h) administrative and order processing expenses.
6.3 These costs may be incurred before Goods are manufactured, received, dispatched or delivered.
6.4 Customer-requested changes following commencement of procurement or production may not be possible.
6.5 Where changes are feasible, additional costs and revised timeframes must be agreed before work proceeds.
6.6 Customer Approval of Specifications
Customers purchasing Custom-Made Goods are responsible for approving the agreed specifications before production.
Specifications may include:
-
Dimensions

Other documented requirements
6.7 Material changes to approved specifications require agreement where applicable.
6.8 The special-order or custom-made status of Goods does not exclude statutory consumer rights.
7. MANUFACTURING AND DELIVERY TIMEFRAMES
7.1 Estimated lead times depend on stock availability, manufacturing schedules, freight arrangements and other relevant circumstances.
7.2 Made-to-order and pre-order Goods may require approximately 4–12 weeks or longer, depending on the product.
7.3 Factors affecting timeframes may include:
(a) supplier production schedules;
(b) international freight availability;
(c) container shipping and port congestion;
(d) customs clearance;
(e) public holidays;
(f) weather and transport disruptions; and
(g) other events beyond Grill King's reasonable control.
7.4 Estimates are not guaranteed delivery deadlines unless expressly agreed.
7.5 Where a material delay arises, Grill King will notify the Customer within a reasonable period and provide updated information where available.
7.6 Customer rights relating to unreasonable delay, non-supply or agreed delivery deadlines remain unaffected.
8. PRODUCT DESCRIPTIONS AND VARIATIONS
8.1 Grill King makes reasonable efforts to accurately describe products, including specifications, dimensions, materials and finishes.
8.2 Minor variations may occur in:
(a) stainless steel shading or finish;
(b) natural stone appearance;
(c) sintered stone or granite pattern;
(d) furniture fabrics and textures;
(e) manufacturing tolerances; and
(f) other natural or non-material characteristics.
8.3 Such variations will not constitute a defect merely because they differ slightly from a display sample, provided the Goods comply with their agreed description and applicable consumer guarantees.
8.4 Grill King may introduce non-material manufacturing improvements that do not adversely affect agreed essential characteristics or performance.
8.5 Material changes to accepted specifications require appropriate notification and agreement where required by law.
8.6 Customers should confirm critical measurements, installation requirements and appliance compatibility before purchasing.
9. SHIPPING AND DELIVERY
9.1 Delivery is governed by Grill King's Shipping & Delivery Policy and the delivery terms agreed at purchase.

9.3 Customers are responsible for arranging suitable assistance and equipment to move Goods beyond the agreed unloading point.
9.4 Customers must disclose relevant access restrictions before dispatch.

10. CUSTOMER DELIVERY RESPONSIBILITIES
10.1 Customers must ensure that:
(a) delivery details are accurate;
(b) reasonable vehicle access is available;

10.4 Customers are responsible for safely moving, storing and handling Goods after delivery is completed.
10.5 Where delivery cannot be completed because of incorrect information, undisclosed access restrictions or Customer unavailability, reasonable additional charges may apply in accordance with clause 11.
11. FAILED DELIVERY AND RE-DELIVERY
11.1 A failed delivery may arise where:
(a) the Customer or authorised recipient is unavailable when required;
(b) the delivery address is incorrect;
(c) safe unloading access is unavailable;
(d) undisclosed access restrictions prevent delivery; or
(e) the Customer requests a change after dispatch.
11.2 Where failure is attributable to the Customer, Grill King may recover reasonable additional charges actually incurred, including:
-
Re-delivery freight
-
Return-to-depot freight
-
Handling expenses
-
Reasonable storage charges
11.3 Charges will be communicated where reasonably practicable before additional services proceed.
11.4 Customers will not be charged for re-delivery caused by Grill King's error or where doing so would interfere with a lawful consumer guarantee remedy.
11.5 Refusal of incorrect, defective or non-compliant Goods is not automatically a chargeable failed delivery.
12. COLLECTION AND STORAGE
12.1 Collection
Customers may collect Goods only from an authorised Grill King warehouse or approved depot where a collection service is available.
12.2 Collection is subject to physical stock availability at that location.
12.3 Grill King is not automatically required to transfer Goods interstate solely to facilitate Customer collection.
12.4 Customers may be required to provide:
(a) an Order number;
(b) relevant collection documentation;
(c) reasonable proof of identity; and
(d) written authorisation where a third party collects Goods.
12.5 Customers must provide suitable transport and safely secure Goods after collection.
12.6 Storage
Where Goods are ready for dispatch or collection, Grill King will provide reasonable notice.
12.7 Customers may request a delivery deferral.
12.8 Subject to prior agreement and available storage capacity, Grill King may offer up to 14 days of complimentary storage for one Customer-requested deferral.
12.9 Further storage may be chargeable where expressly agreed or otherwise lawfully recoverable.
12.10 Any applicable storage rate and commencement date will be disclosed before chargeable storage begins.
12.11 Storage charges will not be applied contrary to statutory rights.
13. CANCELLATIONS, RESTOCKING FEES AND ORDER COMMITMENTS
13.1 General Cancellation Policy
Grill King operates a procurement and manufacturing model under which Goods may be specifically ordered, manufactured, imported or allocated to fulfil Customer Orders.
Once an Order has been accepted, Grill King may incur financial commitments and business expenses.
Grill King does not ordinarily accept change-of-mind cancellations or provide change-of-mind refunds following acceptance.
Where a Customer has no contractual or statutory cancellation right, Grill King is not obliged to approve a change-of-mind cancellation.
13.2 Cancellation Requests
Customers requesting discretionary cancellation must contact Grill King in writing at hello@grillkingbbqs.au.
A cancellation request is not effective until accepted by Grill King or otherwise effective under the Agreement or applicable law.
13.3 Administration and Restocking Fees
Where disclosed and agreed before purchase, approved discretionary cancellations may be subject to the following schedule:
Administration Fee
$500 per cancelled Order.
Restocking Fee — Orders Exceeding $1,000
$1,000 per cancelled Order.
Restocking Fee — Orders of $1,000 or Less
20% of the total Order value.
These charges reflect potential administration, transaction processing, procurement, supplier coordination, stock handling and related business costs.
The fees may be charged together only where legally recoverable, proportionate to Grill King's legitimate interests, and not duplicative.
They are not automatic penalties or minimum amounts payable irrespective of the circumstances.
13.4 Special Order and Manufacturing Costs
Where cancellation involves Special Order Goods or Custom-Made Goods, Grill King may additionally recover reasonable, documented and non-recoverable costs directly attributable to cancellation, to the extent permitted by law.
Such costs may include:
(a) manufacturer deposits;
(b) supplier cancellation charges;
(c) production or fabrication expenses;
(d) specially purchased materials;
(e) unavoidable international freight commitments;
(f) customs or import expenses already incurred;
(g) reasonably necessary handling and warehousing expenses; and
(h) other foreseeable losses lawfully recoverable under the Agreement.
Amounts already recovered through administration or restocking charges will not be charged again.
13.5 Assessment of Cancellation Charges
In determining any amount recoverable, Grill King may consider:
(a) the stage of procurement;
(b) whether manufacturing has commenced;
(c) supplier commitments;
(d) actual expenses incurred;
(e) supplier refunds or credits available;
(f) the ability to resell or reallocate the Goods;
(g) reasonably avoidable losses; and
(h) applicable legal requirements.
13.6 Grill King may provide a calculation or explanation of cancellation charges upon reasonable request.
13.7 Deposits and Refund Balances
Where a discretionary cancellation is approved, Grill King may set off lawfully recoverable amounts against payments received.
Where recoverable costs exceed the Deposit, Grill King may seek the balance if legally entitled.
Where payments received exceed lawful charges, the remaining amount will be refunded.
13.8 Orders Already Dispatched
Where Grill King accepts discretionary cancellation after dispatch, reasonable agreed return freight, handling and other recoverable costs may also apply.
13.9 Statutory Rights
No administration, restocking, manufacturing or cancellation fee will be imposed where it would reduce or interfere with a Customer's lawful remedy under the ACL.
This includes applicable rights arising from major failures, non-supply, misleading product descriptions or other qualifying breaches.
14. CANCELLATION BY GRILL KING
14.1 Grill King may seek to cancel an accepted Order where a lawful termination right arises, including a genuine inability to supply the Goods.
14.2 Examples may include:
(a) permanent supplier unavailability;
(b) legal prohibition on supply;
(c) unforeseen manufacturing impossibility; or
(d) other circumstances entitling Grill King to terminate the Agreement.
14.3 Grill King will inform the Customer within a reasonable period.
14.4 Where applicable, the Customer may be offered an alternative product, a revised timeframe or a refund.
14.5 Any proposed material substitution requires agreement where required by law.
14.6 This clause does not exclude applicable Customer rights to compensation or other legal remedies.
15. PARTIAL DELIVERIES
15.1 Outdoor kitchens and other modular products may consist of multiple components.
15.2 Where certain components are unavailable, Grill King may propose delivery of available components while outstanding items are sourced or manufactured.
15.3 Customers will be advised of material changes to the agreed fulfilment arrangements.
15.4 Outstanding components remain subject to the Agreement.
15.5 Additional standard freight charges resulting solely from Grill King's decision to split a shipment will not be passed to the Customer without agreement.
15.6 Customer rights concerning delayed or incomplete supply remain unaffected.
16. TITLE AND RISK
16.1 Title to Goods remains with Grill King until all amounts payable for those Goods have been paid in full, to the extent permitted by law.
16.2 Where Grill King arranges delivery, risk of accidental loss or damage remains with Grill King until delivery is completed in accordance with the Agreement and applicable law.
16.3 Delivery records, signatures and carrier photographs may be used as evidence of delivery.
16.4 Proof of delivery does not conclusively establish that Goods were free from defects or damage.
16.5 Following completed delivery, Customers are responsible for reasonable care, handling and storage of Goods.
16.6 For independently arranged collection or transport, risk passes according to the agreed arrangements and applicable law.
16.7 Retention of title does not authorise unlawful repossession.
17. TRANSIT DAMAGE
17.1 Customers should inspect Goods and packaging as soon as reasonably practicable after delivery.
17.2 Visible damage should preferably be reported within 24 hours to assist freight investigations.
17.3 Customers should provide available photographs, delivery records and a description of the damage.
17.4 The 24-hour reporting timeframe is requested for operational purposes and does not restrict statutory rights.
17.5 Concealed defects and damage should be reported as soon as reasonably practicable after discovery.
17.6 Unpacking, moving or installing Goods does not automatically invalidate a claim.
17.7 Grill King may investigate whether damage occurred during manufacture, freight, unloading, subsequent handling or installation.
17.8 Where Goods fail to comply with consumer guarantees, Grill King will provide the remedy required by law.
18. INSTALLATION AND PRODUCT OPERATION
18.1 Goods must be installed, operated and maintained in accordance with the relevant instructions and applicable safety requirements.
18.2 Gas and electrical installations must be performed by appropriately licensed or authorised persons where required by law.
18.3 Unless installation is expressly included, Customers are responsible for arranging appropriate professional installation.
18.4 Customers must ensure that:
(a) gas supply and appliance configuration are compatible;
(b) electrical connections meet applicable requirements;
(c) required ventilation and clearances are maintained;
(d) appliances are supported appropriately;
(e) structural installation requirements are met; and
(f) products are used for their stated intended purposes.
18.5 Unauthorised modifications, incorrect installation and improper handling may affect express warranty coverage where they cause or contribute to the claimed damage.
18.6 Such circumstances do not automatically remove statutory rights concerning unrelated defects.
19. BBQ CLEANING AND MAINTENANCE REQUIREMENTS
19.1 BBQ appliances require regular cleaning, maintenance and inspection to operate safely.
19.2 Customers are responsible for following the supplied cleaning and maintenance instructions.
19.3 Appropriate maintenance may include cleaning:
(a) cooking grills and hotplates;
(b) flame tamers;
(c) burners;
(d) grease and drip trays;
(e) grease drainage systems;
(f) internal cooking chamber surfaces; and
(g) other components specified in the operating instructions.
19.4 Excessive accumulation of fat, grease, oil, food residue and other combustible substances may cause:
(a) abnormal flare-ups;
(b) grease fires;
(c) excessive internal heat;
(d) damage to burners and internal panels;
(e) damage to electrical wiring or LED controls;
(f) damage to gas valves or control components; and
(g) other heat-related deterioration.
19.5 Customers must not continue operating a BBQ where an unsafe condition, uncontrolled fire, significant grease accumulation or abnormal operating behaviour is apparent.
19.6 Damage established to have been caused by inadequate cleaning, grease accumulation or improper maintenance is excluded from the voluntary express warranty, subject to the ACL.
19.7 Normal cooking residue or ordinary use does not, by itself, establish misuse or inadequate maintenance.
20. BBQ HOTPLATE CONFIGURATIONS AND RESTRICTED AIRFLOW
20.1 Customers must operate BBQ appliances using cooking-surface configurations approved for the relevant product model.
20.2 Where a BBQ model is designed and approved for a maximum of one solid hotplate, the Customer must not operate the appliance with two solid hotplates simultaneously.
20.3 Installing a second solid hotplate in an unapproved configuration may restrict the airflow and heat dissipation required for safe operation.
20.4 Potential consequences include:
(a) excessive heat accumulation;
(b) overheating beneath the cooking surfaces;
(c) damage to gas burners or flame tamers;
(d) damage to gas valves;
(e) deterioration of electrical wiring;
(f) damage to control knobs and LED components;
(g) abnormal grease ignition; and
(h) damage to the BBQ structure or internal components.
20.5 Customers must not use aftermarket hotplates, solid cooking plates or cooking-surface modifications that obstruct necessary ventilation or exceed the manufacturer's approved operating configuration.
20.6 Where damage is established to have been caused by an unapproved hotplate configuration, the damage is excluded from the voluntary express warranty.
20.7 This restriction applies only to product models for which the relevant configuration is prohibited by the manufacturer's approved design or operating instructions.
20.8 No restriction in this clause excludes rights under the ACL.
21. COMMERCIAL, HOLIDAY RENTAL AND AIRBNB USE
21.1 Customers must consider the intended use of Goods before purchase.
21.2 Unless expressly represented as suitable for commercial or intensive-use environments, products are supplied for their stated intended use.
21.3 Short-term rental, Airbnb, holiday accommodation and other high-frequency settings may require more frequent cleaning, inspection and maintenance.
21.4 Owners and operators should provide users with appropriate operating instructions and arrange maintenance suitable for the frequency and nature of use.
21.5 The voluntary express warranty does not cover damage caused by:
(a) improper guest or tenant operation;
(b) inadequate cleaning;
(c) excessive grease accumulation;
(d) prohibited hotplate configurations;
(e) unauthorised modifications; or
(f) misuse exceeding the product's intended operating requirements.
21.6 Commercial or rental use does not automatically invalidate statutory consumer guarantees or all express warranty coverage.
22. AUSTRALIAN CONSUMER LAW
22.1 These Terms are subject to the Australian Consumer Law.
22.2 Nothing in the Agreement excludes, restricts or modifies any guarantee or remedy that cannot lawfully be excluded.
22.3 Customers may be entitled to a repair, replacement, refund or compensation depending on the nature of a failure.
22.4 For a major failure, applicable statutory rights may entitle a Customer to reject Goods and choose a refund or replacement.
22.5 For a non-major failure, Grill King may be entitled to remedy the failure within a reasonable time.
22.6 Where a failure is not remedied within a reasonable time, further statutory remedies may arise.
22.7 Applicable consumer guarantees may continue beyond the period of a voluntary product warranty.
23. WARRANTIES AGAINST DEFECTS
23.1 Grill King's voluntary Warranty Against Defects is contained in Annexure 1.
23.2 Product-specific express warranty periods and exclusions are outlined in Annexure A and applicable product warranty documentation.
23.3 The express warranty operates in addition to statutory rights.
23.4 Warranty exclusions will be assessed by reference to the cause of the claimed defect and applicable law.
23.5 Grill King may request reasonable evidence, technical information and inspection access to investigate a claim.
23.6 Customers are not required to independently pursue manufacturers or freight providers to obtain remedies owed by Grill King under the ACL.
24. CLEARANCE AND FLOOR-STOCK GOODS
24.1 Clearance and floor-stock Goods may be sold at reduced prices.
24.2 Known material defects or limitations will be disclosed before purchase.
24.3 Customers should inspect floor-stock items where reasonably practicable.
24.4 Specifically disclosed and accepted defects may be relevant to a consumer guarantee assessment.
24.5 Discounted or floor-stock status does not automatically exclude statutory consumer rights.
24.6 Any reduced voluntary express warranty coverage must be clearly disclosed and agreed before purchase, without restricting statutory rights.
25. PRICE MATCHING AND PROMOTIONS
25.1 Grill King may offer discounts, price matching, promotional codes and limited-time sales.
25.2 Promotions are governed by the conditions published with the relevant offer.
25.3 Promotional eligibility may depend on:
(a) product range;
(b) stock availability;
(c) purchase date;
(d) geographical location;
(e) eligible customer category; and
(f) other clearly disclosed promotional requirements.
25.4 Where a Price Match Plus offer is advertised, the specific offer conditions govern any promised price match or additional discount.
25.5 Price-match comparisons may require identical products, verified in-stock availability and comparison of applicable delivery charges.
25.6 Trade quotations, clearance transactions, bulk purchases and marketplace offers may be excluded where those exclusions are clearly disclosed as part of the promotion.
25.7 Accepted Orders will retain the promotional benefits agreed at the time of purchase.
26. LIMITATION OF LIABILITY
26.1 Nothing in these Terms limits liability that cannot lawfully be excluded.
26.2 To the extent permitted by law, each party is responsible for losses legally attributable to its breach, negligence or unlawful conduct.
26.3 Liability may be reduced where another party caused or contributed to the relevant loss, to the extent permitted by law.
26.4 Any limitation of liability for commercial purchases applies only where validly incorporated and enforceable under the relevant law.
26.5 Grill King does not exclude liability for mandatory consumer guarantee remedies or reasonably foreseeable loss where compensation is required by law.
26.6 No blanket exclusion of all consequential loss or automatic purchase-price liability cap applies to statutory consumer claims.
27. PAYMENT DISPUTES AND DEBT RECOVERY
27.1 Customers may contact Grill King to resolve payment discrepancies, product disputes and refund requests.
27.2 Customers retain applicable rights to lodge lawful payment disputes or chargebacks.
27.3 Grill King may retain and provide accurate transaction evidence to relevant banks, payment processors, insurers, legal advisers and dispute resolution bodies where lawful.
27.4 Such evidence may include:
(a) Order Confirmations;
(b) invoices;
(c) payment records;
(d) delivery and collection documentation;
(e) Customer correspondence;
(f) product photographs; and
(g) warranty assessment records.
27.5 Grill King may pursue unpaid amounts legally due under the Agreement.
27.6 Any interest, collection or enforcement charges must be recoverable under the Agreement or applicable law and must not constitute unlawful penalties.
28. INTELLECTUAL PROPERTY
28.1 All Grill King-owned or licensed product images, trademarks, descriptions, drawings, graphics, product designs and other protected materials remain the intellectual property of their respective owners.
28.2 Customers may use supplied product documentation for its intended purpose.
28.3 Commercial reproduction or unauthorised exploitation of protected materials is prohibited except where permitted by law or expressly authorised.
28.4 Nothing in this clause prohibits lawful review, criticism or other legally permitted uses.
29. PRIVACY
29.1 Personal information will be handled in accordance with Grill King's Privacy Policy and applicable legislation.
29.2 Information may be processed for order management, payment verification, delivery, warranty administration, customer service, fraud prevention and other lawful purposes.
29.3 Information may be shared with relevant payment processors, logistics providers, suppliers, technology platforms and professional advisers as permitted by law.
29.4 Acceptance of these Terms does not constitute unlimited consent to unrelated uses of personal information.
30. FORCE MAJEURE
30.1 Neither party will be liable for delay or failure caused by events beyond its reasonable control to the extent permitted by law.
30.2 Relevant events may include natural disasters, major shipping disruptions, government restrictions and other extraordinary circumstances.
30.3 The affected party must take reasonable steps to minimise the consequences.
30.4 If an event causes substantial delay or prevents supply, the parties will seek an appropriate resolution.
30.5 Applicable statutory rights remain unaffected.
31. DISPUTES AND COMPLAINTS
31.1 Customers may contact Grill King at hello@grillkingbbqs.au.
31.2 Grill King will make reasonable efforts to investigate complaints and communicate an appropriate resolution.
31.3 The parties are encouraged to attempt good-faith resolution where practicable.
31.4 Either party may pursue available remedies through a competent court, tribunal, regulator or applicable dispute resolution process.
31.5 Nothing in these Terms requires mandatory paid mediation or restricts access to statutory remedies.

2. AUSTRALIAN CONSUMER LAW NOTICE
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The benefits provided by this express Warranty Against Defects are additional to any rights or remedies available under the Australian Consumer Law or other applicable legislation.
3. EXPRESS WARRANTY COVERAGE
3.1 Subject to the terms of this Warranty, Grill King warrants that eligible Goods will be free from defects in materials and workmanship during the applicable express Warranty Period.
3.2 Where a defect covered by this voluntary express warranty arises during the applicable period, Grill King will repair the Goods, replace the defective Goods or provide appropriate replacement components in accordance with this Warranty.
3.3 Where identical parts are no longer available, Grill King may offer reasonably equivalent compatible components, subject to applicable law.
3.4 The applicable express Warranty Period is determined by the product category and any product-specific warranty documentation.
3.5 Unless otherwise specified, the express Warranty Period commences on the date of delivery or Customer collection.
3.6 Statutory consumer guarantees may apply beyond the express Warranty Period.
4. MAKING A WARRANTY CLAIM
4.1 Customers should report suspected defects as soon as reasonably practicable after discovery.
4.2 Claims may be lodged by emailing hello@grillkingbbqs.au.
4.3 The Customer should provide:
(a) proof of purchase;
(b) product identification;
(c) a description of the problem;
(d) relevant photographs or video where reasonably available; and
(e) other information reasonably necessary to investigate the claim.
4.4 Grill King may request inspection of the Goods or relevant technical information.
4.5 For a claim under this voluntary express warranty, notification should be given during the applicable Warranty Period. This does not limit statutory consumer guarantee rights.
4.6 The Customer must not be required to undertake unsafe dismantling or transport to pursue a claim.
4.7 Customers may request reimbursement of reasonable claim-related expenses where such expenses are payable by Grill King under this Warranty or applicable law, by emailing the claim details and supporting receipts to hello@grillkingbbqs.au.
5. WARRANTY EXCLUSIONS
5.1 General Exclusions
Subject to Australian Consumer Law rights, this voluntary express warranty does not cover damage caused by:
(a) misuse or abuse;
(b) accidental damage after delivery;
(c) improper handling;
(d) incorrect installation;
(e) unauthorised modifications or repairs;
(f) inadequate cleaning and maintenance;
(g) improper operating practices;
(h) environmental exposure beyond stated product specifications;
(i) ordinary wear and tear; or
(j) damage caused by independent third parties not engaged by Grill King.
An exclusion applies only to the extent the relevant condition caused or contributed to the claimed failure.
5.2 Cosmetic Corrosion and Surface Deterioration
The express warranty excludes cosmetic corrosion, staining or deterioration caused by environmental exposure, inadequate maintenance, surface contamination or other external circumstances rather than defective materials or workmanship.
Examples include:
(a) tea staining on stainless steel;
(b) surface rust caused by salt deposits or contaminants;
(c) discolouration caused by chemical exposure;
(d) corrosion originating from scratches or abrasions;
(e) staining from grease, dirt, organic debris or fertilisers;
(f) oxidation resulting from insufficient maintenance;
(g) deterioration caused by inappropriate cleaning agents; and
(h) corrosion at welds, joins, fittings or exposed surfaces attributable to external contaminants.
Stainless steel is corrosion-resistant but is not inherently immune to corrosion or surface staining.
This exclusion does not apply where the relevant condition is attributable to defective materials, defective workmanship, inadequate durability or another failure covered by applicable consumer guarantees.
5.3 Coastal, Marine and High-Corrosion Exposure
Coastal and marine environments may accelerate corrosion.
Higher-risk environments may include:
(a) seafront properties;
(b) locations exposed to salt spray;
(c) properties affected by airborne marine salts;
(d) areas near saltwater swimming pools;
(e) enclosed chlorinated environments;
(f) chemically contaminated environments; and
(g) other locations involving elevated corrosive exposure.
Unless a product is expressly represented as suitable for a particular exposure environment, the express warranty excludes corrosion or deterioration caused by environmental conditions beyond the product's stated suitability or by inadequate maintenance in those conditions.
Additional inspection, cleaning and preventative maintenance may be necessary.
Installation at a coastal address does not automatically establish that damage was caused by marine exposure.
Where a product is expressly represented as suitable for coastal or similar use, warranty assessments will take that representation into account.
5.4 Stainless Steel Cleaning and Maintenance
Stainless steel surfaces require appropriate care.
Customers must follow applicable cleaning and maintenance instructions, including where appropriate:
(a) removal of salt deposits;
(b) removal of grease and contaminants;
(c) cleaning with suitable non-abrasive products;
(d) avoiding aggressive chlorine-based chemicals;
(e) avoiding steel wool or materials that deposit iron contaminants;
(f) rinsing and drying surfaces when required; and
(g) inspecting welds, joins and exposed edges.
Damage caused by failure to undertake reasonably required maintenance is excluded from the voluntary express warranty.
5.5 Incorrect Installation and Subsequent Modifications
The express warranty excludes damage caused by:
(a) incorrect gas installations;
(b) unauthorised gas conversions;
(c) incorrect regulators, valves or fittings;
(d) inadequate ventilation;
(e) non-compliant electrical connections;
(f) incorrect structural support;
(g) unauthorised cutting, drilling or welding;
(h) improper modifications to cabinetry;
(i) incorrect appliance installation;
(j) damage occurring during subsequent movement or handling; or
(k) improper repairs by third parties not engaged by Grill King.
This exclusion applies only where the relevant installation, modification or handling caused or contributed to the defect.
5.6 BBQ Cleaning and Grease Accumulation
The Customer is responsible for undertaking regular BBQ cleaning and maintenance.
The express warranty does not cover damage caused by:
(a) excessive grease or fat accumulation;
(b) failure to clean grease trays;
(c) blocked grease drainage systems;
(d) excessive food residue on flame tamers;
(e) grease fires attributable to inadequate maintenance;
(f) uncontrolled flare-ups resulting from accumulated combustible material;
(g) continued use after unsafe operating conditions become apparent; or
(h) excessive heat caused by accumulated grease or improper maintenance.
Damage to burners, valves, wiring, control knobs, LED components and internal panels arising from such causes is excluded from voluntary express warranty coverage.
Normal cooking residue and ordinary cooking-related flare-ups do not automatically establish misuse.
5.7 Two-Hotplate Restriction
Where the relevant BBQ model is designed and approved for a maximum of one solid hotplate, customers must not operate two solid hotplates simultaneously.
This restriction is intended to prevent unapproved obstruction of airflow and excessive heat accumulation.
Operating an affected BBQ model with two solid hotplates may cause:
(a) restricted ventilation;
(b) abnormal temperatures;
(c) burner damage;
(d) damage to valves and controls;
(e) deterioration of electrical wiring;
(f) damage to LED lighting;
(g) internal structural damage; and
(h) increased fire risk.
The express warranty excludes damage established to have been caused by a prohibited hotplate configuration or unauthorised cooking-surface modification.
This restriction must be read together with the model-specific operating instructions.
It does not apply to BBQ models expressly designed and approved for simultaneous use of two solid hotplates.
5.8 Airbnb, Holiday Rentals and Commercial Use
Products used in holiday rentals, Airbnb accommodation or high-frequency environments may require increased maintenance.
The express warranty excludes damage caused by:
(a) improper operation by guests or tenants;
(b) inadequate cleaning between uses;
(c) grease fires attributable to poor maintenance;
(d) unauthorised cooking-surface arrangements;
(e) improper installation or modifications; or
(f) other misuse inconsistent with the product's intended operating requirements.
Rental or commercial use does not automatically invalidate all warranty coverage or applicable statutory rights.
5.9 Ordinary Wear and Tear
The express warranty does not cover ordinary deterioration arising from normal use, where this does not constitute defective workmanship, defective materials or a failure of applicable consumer guarantees.
Depending on the product, this may include:
(a) ordinary surface wear;
(b) natural fabric creasing;
(c) normal weathering;
(d) reasonable cosmetic ageing;
(e) ordinary consumable component wear; and
(f) non-defective changes in appearance from appropriate use.
5.10 Assessment of Excluded Damage
Where Grill King considers an exclusion relevant, it may undertake a reasonable technical assessment.
Evidence may include:
(a) photographs;
(b) relevant delivery documentation;
(c) installation records;
(d) product maintenance information;
(e) condition of burners and grease trays;
(f) hotplate configuration;
(g) indications of corrosion or heat exposure; and
(h) other relevant technical findings.
Each claim will be assessed individually.
The fact that a product has been unpacked, installed or used does not, by itself, invalidate a legitimate claim.
6. WARRANTY REMEDIES
6.1 Where a claim is covered by the express Warranty, Grill King will repair the defective Goods, replace defective components or provide replacement Goods as appropriate under the express warranty undertaking.
6.2 Where a statutory consumer guarantee applies, the Customer's legal remedies take precedence.
6.3 Where identical replacement components are unavailable, Grill King may offer equivalent compatible parts, subject to applicable law.
6.4 Repairs and replacement arrangements will be undertaken within a reasonable period having regard to the circumstances.
7. WARRANTY FREIGHT AND EXPENSES
7.1 Customers may be asked to supply reasonable preliminary evidence before physical inspection or transport is arranged.
7.2 Customers will not be required to bear freight or collection expenses contrary to applicable law.
7.3 Where faulty Goods are large, heavy or difficult to transport, Grill King will meet its statutory obligations to collect them or arrange suitable transportation at its expense.
7.4 Where a Customer incurs reasonable return costs that Grill King must reimburse, the Customer should retain receipts and submit them to hello@grillkingbbqs.au.
7.5 Where investigation establishes that the issue is not covered by the voluntary express warranty or applicable statutory obligations, Grill King may offer a separately quoted paid repair or replacement.
7.6 Chargeable work will not proceed without appropriate Customer agreement.
8. WARRANTY PERIODS
8.1 Applicable express Warranty Periods are set out in Annexure A and relevant product-specific warranty documentation.
8.2 Warranty coverage begins from delivery or collection unless a separately provided applicable warranty expressly states otherwise.
8.3 The expiry of an express Warranty Period does not automatically extinguish rights under the ACL.
9. WARRANTY BENEFICIARY
9.1 This voluntary express Warranty is provided to the original purchaser unless otherwise specified in the relevant product documentation.
9.2 This provision does not restrict statutory rights available to other persons under applicable law.
10. GOVERNING LAW AND GENERAL CONDITIONS
10.1 This Warranty is governed by the applicable laws of New South Wales and the Commonwealth of Australia.
10.2 Any unenforceable provision will be severed to the extent permitted by law.
10.3 Statutory consumer guarantees prevail over inconsistent express warranty terms.
